New Shoots Photography Training   

Terms and Conditions

 

This agreement is between New Shoots Photography Training, hereinafter referred to as the "Trainer", operating in the United Kingdom, and the signers of this Photography Training agreement, hereinafter referred to as the "Clients", collectively referred to as the "Parties", with the photography training session detailed below.

The package list and price list and/or documents attached to this contract are integral parts of this document. The contract terms, agreement, and price list are the only legally binding documents between the Parties.

It is mutually agreed that the following terms of agreement, form an integral part of this contract and that no variations or modifications of this contract shall be effective unless accepted by both the Trainer and the Client, in writing.

 

  • Booking and Payment – Upon Booking, the trainer will ensure the date and time agreed upon will be reserved for the agreed workshop. The place on the workshop is only reserved for the client on full payment. By making a booking for a workshop you show you have read and understood and agree with the Terms and Conditions in this document.

  • Change of Date or Venue – Should for any unforeseen reason the Trainer need to change the date, time or venue of the workshop they will endeavor to notify the client immediately via email or by phone.

    If the client is unable to attend on the new date or at the new venue the trainer will offer them an alternative date, if the client is unable to attend the workshop on the alternative date/s or venues then they should be offered a full refund regardless of the timescales.

 

  • Cancellation and Postponement by Client – Should the Client cancel their place on any New Shoots Photography Workshop an unconditional refund exists up until  …7….days prior to the reserved date, at which point the Trainer shall retain 50% of the fee up until 48 hours prior to the reserved date, whereupon the whole fee would be retained.

 

  • Cancellation and Postponement by Trainer – Should for any unforeseen reason the Trainer need to cancel or postpone the workshop they will endeavor to notify the client immediately via email or by phone. If the client is unable to attend on an alternative date the trainer offers, then they should be offered a full refund regardless of the timescales.

 

  • Limit of Liability – In the unlikely event that the Trainer is injured, becomes too ill, or has an emergency that prevents them from attending the workshop, the Trainer will make arrangements to reschedule the workshop. If a suitable day for reschedule is not agreed upon, the Client agrees that responsibility and liability of the Trainer to the Client is limited to the return of all payments received for the workshop.

    New Shoots Photography Training cannot be held responsible for any reckless or dangerous activity by participants of the New Shoots Photography Training course, which results in accidents or hurt to either themselves or any other party. Clients must be vigilant, and be aware of all traffic at all times when taking pictures so that they remain safe, both for themselves and their subjects and third parties.

    Clients must be responsible for all their own possessions including camera kit and mobile phones. All clients should make sure that all their equipment is covered on their home insurance policy for loss, theft and accidental damage, as the Trainer can take no responsibility for loss or theft of personal belongings.

    The Trainer can not be held responsible for any damage or malfunction to Clients equipment occurring during the workshop or on the downloading of any apps.

 

  • Digital Negatives, Prints and Copyright ­– Any pictures taken by the Trainer during any workshop remains the copyright of the Trainer and are protected by International Copyright Law (all rights reserved) and the Photographer retains the copyright to all photos and images produced.

    The Trainer asserts her moral rights to be identified as the author wherever and whenever her photographs are copied or distributed by any means. The Trainer retains all intellectual property rights including copyright to the images that she takes during any session.
     

  • Usage – We reserve the right to use any images taken on our workshops for marketing purposes within New Shoots Photography Training. If a client does not want their image used in this way, they must not fill in the model release provided and tell the trainer.

  • Complaints  It's important to us at New Shoots, that all our clients are happy with all our services. However if any of our clients have a complaint regarding any workshop, service or treatment by New Shoots, we will treat this very seriously, we will listen and value all feedback given. We ask for all complaints to be sent to us by email to info@newshootsphototraining.com or in writing to Complaints Department, New Shoots Photography Training, Banks, The Studio, Chislehurst Road, Chislehurst, Kent BR7 5LD.We will endeavour to respond to all complaints within 28 days. Should a complaint not be resolved between the client and the trainer, New Shoots will find an independent third party to mediate.
